These Terms and Conditions govern the use of the website heavyduties.ro and all purchases made through it. By placing an order you confirm that you have read and accepted these terms, together with our Return Policy, Privacy Policy and Cookie Policy.

1. Who we are

The website heavyduties.ro is operated by MOTO PROTECT HD SRL, Mihai Eminescu 5B, Luna de Sus 407281, com. Florești, jud. Cluj, Romania · VAT No. RO30762017 · Trade Register No. J12/2714/2012 · Email: heavyduties@gmail.com. In these terms, “we”, “us” and “Heavy Duties” refer to MOTO PROTECT HD SRL; “you” refers to the person placing an order.

2. Products and fitment

We design and manufacture motorcycle luggage, racks and protection, and we resell selected products from other brands. Product photos are illustrative; finishes may vary slightly between production batches.

Each product page lists the motorcycle models and years it is designed for. Please check that the model, year and version of your motorcycle match before ordering. If you are unsure, contact us before you buy — we are happy to confirm fitment.

Mounting must be done carefully, following our instructions, or by a qualified mechanic. We are not liable for damage caused by incorrect installation, modifications to the product, use on a motorcycle it was not designed for, or exceeding the stated load limits.

3. Orders and contract

Placing an order is an offer to buy. You will receive an automatic email confirming that we have received your order; the contract is concluded when we confirm the order or ship the products. We may refuse or cancel an order in case of obvious pricing errors, stock unavailability or suspected fraud — any amount paid will be refunded in full.

You can check out as a guest or with a customer account. You are responsible for keeping your account credentials confidential.

4. Prices and VAT

Prices are shown in euro (EUR) and exclude VAT. As an EU business we apply the VAT rate of your delivery country under the EU One-Stop-Shop (OSS) scheme. VAT and shipping are calculated automatically at checkout, so you always see the final total before you pay. For deliveries outside the EU, import duties and taxes may be charged by the destination country and are paid by the customer.

5. Payment

You can pay by card through our payment processor Stripe, or by bank transfer to the account shown on your order confirmation or invoice. Card data is processed by Stripe and never stored by us. Orders paid by bank transfer are processed once the payment is received.

6. Production and delivery

Products in stock are usually shipped within a few working days. Made-to-order items and custom configurations (size, colour, lid opening, options) may take longer; we will tell you the estimated time if it exceeds the usual delay. Delivery times given by couriers are estimates.

Shipping costs depend on the size, weight and destination of your order and are shown at checkout. You will receive tracking details by email when your parcel ships. Please check the parcel on delivery and note any visible damage on the courier’s receipt. If a parcel is lost in transit, we will send you a replacement.

7. Right of withdrawal

If you are a consumer, you may withdraw from the contract within 14 calendar days from the day you receive the products, without giving any reason, in accordance with EU Directive 2011/83/EU and Romanian Government Emergency Ordinance no. 34/2014. To do so, notify us by email at heavyduties@gmail.com before the deadline. You may use the standard withdrawal form below, but it is not mandatory.

Returned products must be unused, complete and well packed. We refund the price of the products and the standard outbound shipping cost within 14 days of receiving your withdrawal notice; we may withhold the refund until we have received the products back. Return shipping costs are paid by you, unless the product is defective or we sent the wrong item. Full details in our Return Policy.

8. Legal guarantee of conformity

All products benefit from the legal guarantee of conformity for consumers of 2 years from delivery, under EU Directive 2019/771 and Romanian Government Emergency Ordinance no. 140/2021. If a product is not in conformity — for example a manufacturing defect — contact us with your order number and photos. We will repair or replace it, or, if that is not possible, offer a price reduction or refund.

The guarantee does not cover normal wear (scratches, abrasion of coatings, worn corner protectors or straps), damage from accidents, crashes or falls, incorrect installation, overloading, or modifications. Wear parts such as corners, strap holders and gaskets are available as spare parts. The Impact Release system is designed to let panniers detach in a strong impact; a released pannier is the system working as intended, not a defect.

9. Liability

Our liability is limited to the value of the products purchased, except where the law does not allow such limitation (for example in case of intent, gross negligence or personal injury). Adventure riding carries inherent risks; our products reduce but cannot eliminate the risk of damage or injury.

10. Intellectual property

All content on this website — texts, photos, videos, logos, the Heavy Duties name and the Rhino design — belongs to MOTO PROTECT HD SRL or its partners and may not be copied or used without written permission.

11. Personal data

We process your personal data to fulfil your order and as described in our Privacy Policy, in accordance with the GDPR (EU Regulation 2016/679).

12. Complaints and disputes

If you are not satisfied, please write to us first at heavyduties@gmail.com — we will answer as quickly as possible. Consumers may also contact the Romanian National Authority for Consumer Protection (ANPC), use alternative dispute resolution (SAL) or the EU Online Dispute Resolution platform (ODR/SOL).

These terms are governed by Romanian law. This does not deprive consumers of the protection granted by the mandatory laws of their country of residence.

13. Changes

We may update these terms from time to time. The version published on the date of your order applies to that order.
